Terms of Use

The information and content contained within this app is always subject to the following terms and conditions (“Terms of Use”) and your access to this platform and continued usage constitutes complete acceptance of these Terms of Use. For the purpose of these Terms of Use, the terms “platform” and “app” and “website” and “site” have been used interchangeably.

These Terms of Use are applicable to us and individual users of the platform. By using this platform, you are agreeing to all the terms and conditions as set out.

In these Terms, ‘we”, “us’ and “our” mean Hero Wellbeing (defined below) and “you” and ‘your” means the individual who is using the platform and app.

Who We Are

User Data Protection and Privacy Policy

All information entered into the platform will be treated with the strictest confidence, and securely stored in accordance with the Data Protection Act 1998 and subsequently General Data Protection Regulations (GDPR). Absolutely no personal information will be divulged or made available to any other individual or organization.

We care about the security of our users. Whilst we work hard to protect the security of your Personal Data, User-Generated Content, and account, we cannot guarantee that unauthorised third parties will not be able to defeat our security measures.

Please let us know right away if you believe your account has been hacked or compromised.

User Data Collection and Use

In order to provide a quality service and the full range of platform functionality, some personal information is stored. This includes, but is not limited to, data entered into the My Account and Health Assessment sections. By default, no personal information is made available to any other individual or organisation.

You may stop using the service at any time and request that your account and all related data be deleted. This will be dealt with within a reasonable working timescale.

Anonymous, collated, data may be provided to your employer or EAP provider. This is to enable us and them to assess the effectiveness of current health and wellbeing policies and identify areas for change. No individual can be identified from this data at any stage.

Private Consultations: The only exception to the above privacy policy is activated when an individual user requests a private one-to-one Consultation (via the video chat, online live chat or telephone consultation function) with a professional using the appointment request service within the platform. In this case, explicit consent to share data with the Consultant is requested at the time of booking and must be provided by the user before the consultation may proceed.

Cookie Policy

We use cookies to help us remember and process site preferences so we can offer you better site experiences and tools in the future. We do not share cookies with third parties.

Switching off cookies will still allow you to view the majority of content on our site, however, it will prevent you logging in and so accessing personalised information. It will also prevent us from remembering your login User ID if you ask us to do so, and may restrict your use of our interactive tools and of some services available through linked sites.

Social Network Sharing

There may be share buttons to enable you to easily share articles with your friends through Facebook, Twitter or other social networks. These sites may set a cookie when you also log in to their service. We do not control the dissemination of these cookies and therefore you should check the relevant third party website for more information on these.

Service Updates, Changes and Limitations

Our Services are constantly evolving. With the launch of new products, services, and features, we need the flexibility to make changes, impose limits, and occasionally suspend or terminate certain Services. We may also update our Services, which might not work properly if you do not install the updates.

Service Monitoring and Suspension

We reserve the right to refuse to provide the Services to anyone, and can monitor, terminate or suspend your account or access to the Services at any time.

Limitation of Liability

We are building the best Services we can for you but can’t always promise they will be perfect.

We are not liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of this platform.

Physical Activity and Nutrition Guidance

It’s important to us that you stay healthy while achieving your health and fitness goals. Please be responsible and use your best judgment and common sense. We provide our Services for information purposes only and cannot be held liable if you become injured or something goes wrong. In particular, whilst most of the content is certainly helpful, it must never replace good judgment or medical advice.

We care about your safety. You should consult with your GP and consider the associated risks before using our Services in connection with any physical activity, wellness or fitness program, or any dietary program or guidance. By using our Services, you agree, represent and warrant that you have received consent from your GP to participate in wellness and fitness programs, workouts, exercises or any of the related activities made available to you in connection with the Services, and that you have consulted with them before making any dietary changes based upon information available.

Everyone’s condition and abilities are different, and participating in the activities promoted by our Services is at your own risk. If you choose to participate in these activities, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such activities. Activities promoted by the Services may pose risks even to those who are currently in good health.

Updates to Terms

In the event that any portion of these Terms of Use is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

These Terms of Use shall be governed by and construed in accordance with English law.

We reserve the right to modify these Terms by (i) posting revised Terms on and/or through the Services, and/or (ii) providing advance notice to you of material changes to the Terms, generally via email where practicable, and otherwise through the Services (such as through a notification on the homepage of the Hero Wellbeing website or in our applications).
